Who Can Be a Sponsor and Who Can Be Sponsored?

Understanding the eligibility criteria for both the sponsor and the sponsored person is crucial for a successful application.

Sponsor Eligibility:

You may be eligible to sponsor if you meet the following requirements:

  • You are 18 years of age or older.
  • You are a Canadian citizen, a permanent resident living in Canada, or a person registered under the Canadian Indian Act.
  • If you are a Canadian citizen living abroad, you must demonstrate your intention to return to Canada once your sponsored loved one becomes a permanent resident. Permanent residents must reside in Canada to sponsor.
  • You are not receiving social assistance for reasons other than a disability.
  • You can demonstrate the financial capacity to provide for the basic needs of your spouse or partner and any dependent children for the duration of the undertaking.

As a sponsor, you will sign an undertaking, a binding promise to provide financial support for your sponsored family member for three years from the date they become a permanent resident. This includes housing, food, clothing, personal hygiene products, and non-insured medical expenses.

Who You Can Sponsor:

The person you wish to sponsor must be at least 18 years old and pass all background, security, and medical checks. Your relationship must fall into one of three categories:

  1. Spouse: You are legally married to each other. If married outside Canada, the marriage must be legally recognized in the country where it took place.
  2. Common-Law Partner: You have lived together in a marriage-like relationship for at least 12 consecutive months.
  3. Conjugal Partner: You have been in a continuous and committed relationship for at least 12 months but cannot live together due to significant obstacles (e.g., immigration barriers, legal restrictions, cultural or religious reasons). This category is typically for individuals outside Canada.

Canada recognizes same-sex marriages and common-law partnerships, and individuals in these relationships are eligible to apply under the respective categories.

The Spousal Sponsorship Application Process

The application process involves submitting two applications concurrently: your sponsorship application and your loved one's permanent residence application. Samakav Immigration Corp simplifies this multi-step process for you:

  1. Initial Assessment: We begin by evaluating your eligibility and determining the best application stream (Inland or Outland).
  2. Document Gathering & Preparation: We provide detailed checklists and assist in collecting all necessary documents, including proof of genuine relationship, financial stability, and personal identification.
  3. Form Completion: Our team accurately completes all required government forms, ensuring no details are missed and avoiding common errors that can lead to delays or refusals.
  4. Fee Payment: We guide you through the payment of government processing fees, which typically include the sponsorship fee, principal applicant processing fee, Right of Permanent Residence Fee, and biometrics fee (totaling approximately CAD $1,290, plus additional fees for dependent children or Quebec residents).
  5. Application Submission: We meticulously review and submit your complete application package to Immigration, Refugees and Citizenship Canada (IRCC).
  6. Correspondence & Follow-up: We act as your representative, handling all communications with IRCC and responding to any requests for additional information.

Inland vs. Outland Sponsorship:

  • Outland Sponsorship: Generally chosen when the sponsored person lives outside Canada. The sponsored person may be able to visit Canada during processing, provided they have appropriate visitor status. Conjugal partner applications can only be processed Outland.
  • Inland Sponsorship: Applicable when both the sponsor and sponsored person are living together in Canada, and the sponsored person has valid temporary status (e.g., visitor, worker, student). A significant benefit of Inland sponsorship is the possibility for the sponsored person to apply for an Open Work Permit, allowing them to work in Canada while their permanent residence application is being processed.
