Canada Outland Spousal & Common-Law Partner Sponsorship

Sponsor your spouse or common-law partner for Canadian Permanent Residence from outside Canada. Our RCIC experts guide you through the Outland sponsorship process, including Open Work Permit eligibility.

Uniting Families: Canada Outland Spousal & Common-Law Partner Sponsorship

At Samakav Immigration Corp, we understand the importance of family unity. Our Outland Spousal and Common-Law Partner Sponsorship service is designed for Canadian citizens and permanent residents who wish to bring their loved one to Canada as a permanent resident, regardless of where the sponsored partner currently resides in the world. This pathway is ideal for couples where the sponsored individual lives abroad or wishes to maintain the flexibility to travel in and out of Canada during the application process.

The Outland sponsorship process allows foreign nationals to obtain Canadian Permanent Resident (PR) status, enabling them to live, work, and study anywhere in Canada. Our regulated Canadian immigration consultants (RCICs) are here to provide expert guidance, ensuring your application is complete, accurate, and has the best chance of success.

Key Benefits of Outland Spousal Sponsorship

  • Global Reach: Sponsor your spouse or common-law partner even if they are living outside of Canada.
  • Travel Flexibility: If the sponsored person is already in Canada, they can travel in and out of the country while their application is being processed, unlike the Inland sponsorship stream.
  • Open Work Permit Eligibility: Eligible Outland applicants and their dependent children may apply for an Open Work Permit (OWP) to work in Canada while their permanent residence application is in process.
  • Clear Pathway to PR: A direct route for your loved one to gain permanent resident status in Canada.

Eligibility Requirements for Outland Sponsorship

To successfully sponsor a loved one through the Outland stream, both the sponsor and the sponsored person must meet specific criteria set by Immigration, Refugees and Citizenship Canada (IRCC).

Sponsor Requirements:

  • Be a Canadian citizen or a permanent resident of Canada.
  • Be at least 18 years of age.
  • Reside in Canada or demonstrate intent to return to Canada once the sponsored person becomes a permanent resident.
  • Not have sponsored another spouse or common-law partner within the last five years.
  • Not be in prison, charged with a serious offence, or bankrupt.

Sponsored Person Requirements:

  • Be at least 18 years of age.
  • Be in a genuine relationship with the sponsor.
  • Not be inadmissible to Canada for reasons such as criminality, health, or financial grounds.

Recognized Relationship Types:

  • Spouse: You are legally married, and your marriage is valid under the laws of the jurisdiction where it took place and under Canadian law.
  • Common-Law Partner: You have cohabited with your partner in a marriage-like relationship for at least 12 consecutive months.
  • Conjugal Partner: You have been in an ongoing and committed relationship for at least 12 months but cannot live together due to significant legal or immigration barriers beyond your control. This category is exclusively processed through the Outland stream.

The Outland Sponsorship Process

Navigating the Outland sponsorship application involves several critical steps. Samakav Immigration Corp simplifies this journey for you:

  1. Initial Consultation & Eligibility Assessment: We begin by thoroughly assessing both the sponsor and sponsored person's eligibility to ensure this is the right pathway for you.
  2. Document Gathering & Application Preparation: Our team assists you in compiling all necessary supporting documents, completing the required IRCC forms accurately, and ensuring all details reflect the genuineness of your relationship.
  3. Application Submission: We meticulously review your complete application package and submit it to the appropriate IRCC visa office, ensuring all instructions are followed.
  4. Processing & Communication: IRCC aims to process most spousal sponsorship applications within 12 months. During this period, we act as your representative, communicating with IRCC on your behalf and providing updates on your application's progress.
  5. Open Work Permit Application (Optional): If eligible, we can assist the sponsored person in applying for an Open Work Permit, allowing them to work in Canada while awaiting their PR decision.
  6. Final Decision: Upon approval, your loved one will receive their Permanent Resident status, ready to begin their new life in Canada.

Special Considerations for Quebec Residents

If the sponsor resides in Quebec, additional steps are required due to Quebec's unique immigration laws. After meeting federal requirements and receiving initial approval from IRCC, sponsors must also apply to the Government of Quebec for a Certificat de sélection du Québec (CSQ – Quebec Selection Certificate). Our team is proficient in Quebec's immigration procedures and will guide you through this provincial undertaking process.

Open Work Permit for Outland Applicants

As of 2023, certain foreign nationals applying under Outland sponsorship may be eligible for an Open Work Permit (OWP). To qualify, the applicant must:

  • Be the spouse, common-law partner, or conjugal partner of a Canadian citizen or permanent resident living in Canada.
  • Be included in a Permanent Residence application and have received an Acknowledgement of Receipt (AOR) letter from IRCC.
  • Be living in Canada with their sponsor.

Dependent children of eligible principal applicants may also qualify for an OWP under similar conditions. We recommend submitting the OWP application concurrently with the sponsorship application for the quickest processing.
