Who Can Sponsor and Who Can Be Sponsored?
To be eligible to sponsor a family member, you must generally be at least 18 years old, a Canadian citizen or permanent resident living in Canada, and not be in prison, bankrupt, under a removal order, or charged with a serious offence. There are also specific restrictions, such as not having been sponsored as a spouse yourself within the last five years, or having failed to support a previously sponsored relative.
Spouse, Common-Law Partner, or Conjugal Partner Sponsorship
This is one of the most common categories. The sponsored person must be at least 16 years of age and not too closely related by blood to the sponsor.
- Spouse: You must be legally married. If married outside Canada, the marriage must be valid under the laws of the country where it took place and under Canadian federal law. Same-sex marriages are valid.
- Common-Law Partner: You must have cohabited continuously for at least one year, excluding brief absences.
- Conjugal Partner: This category applies in exceptional circumstances where partners cannot qualify as spouses or common-law partners due to factors beyond their control (e.g., immigration barriers, legal restrictions on same-sex relationships or divorce). The relationship must be mutually dependent for at least one year, demonstrating emotional, financial, and physical closeness.
Dependent Child Sponsorship
You can sponsor your biological or adopted child if they meet the definition of a dependent child:
- They are under 22 years of age and do not have a spouse or common-law partner.
- They are 22 years of age or older, have depended substantially on the financial support of the parent since before the age of 22, and are unable to be financially self-supporting due to a physical or mental condition.
Parents and Grandparents Program (PGP)
This program allows Canadian citizens and permanent residents to sponsor their parents and grandparents for permanent residence. Sponsors must meet specific income thresholds (Minimum Necessary Income - MNI) and commit to providing financial support for 20 years. The PGP typically operates on an invitation-to-apply basis, often with an annual intake period.
Parent and Grandparent Super Visa
For parents and grandparents who wish to visit Canada for extended periods (up to 5 years at a time, renewable for up to 2 years), the Super Visa is an excellent option. Sponsors must be the child or grandchild, provide a written commitment of financial support, and meet the MNI. The sponsored person must be admissible as a visitor, undergo an immigration medical examination, and obtain Canadian medical insurance coverage for at least one year.
