The Canadian immigration landscape is constantly evolving, and staying informed is crucial for anyone pursuing permanent residence. Recently, Immigration, Refugees and Citizenship Canada (IRCC) announced significant updates to the Atlantic Immigration Program (AIP), specifically targeting how employment changes and employer ownership transitions are handled. These new rules introduce stricter requirements and a critical 90-day deadline that all AIP applicants must be aware of.
At Samakav Immigration Corp., led by our Regulated Canadian Immigration Consultant (RCIC), Samaneh Kavei, we understand the complexities and potential anxieties these changes can bring. Our goal is to provide clear, expert guidance to help you navigate these updates successfully and protect your immigration journey.
## What Are the Key Changes to the Atlantic Immigration Program?
Previously, if an AIP applicant experienced an employment change or their employer's ownership shifted while their permanent residence (PR) application was pending, IRCC officers would generally put the application on hold, awaiting updated documents. This approach offered a degree of flexibility. However, the new instructions, effective July 23, 2026, have introduced a firm 90-day deadline. If an applicant fails to provide the required documentation within this timeframe, their PR application *will be refused*.
This is a fundamental shift, emphasizing the need for immediate action and meticulous adherence to IRCC's requirements. Applicants will now receive a Procedural Fairness Letter (PFL) advising them of the necessary documents and the strict 90-day submission window.

## Understanding the Atlantic Immigration Program (AIP)
Before delving deeper into the specifics, let's briefly recap what the Atlantic Immigration Program is. The AIP is an innovative employer-driven pathway designed to help foreign nationals and international graduates settle permanently in Canada's four Atlantic provinces: New Brunswick, Newfoundland and Labrador, Nova Scotia, and Prince Edward Island. It aims to address labour shortages and support economic growth in the region.
To qualify, applicants generally need a full-time job offer from a designated employer in one of these provinces, along with meeting requirements for work experience, education, language proficiency, and settlement funds. A key feature of the AIP is the opportunity to apply for a two-year, employer-specific work permit tied to the job offer supporting their PR application, which is particularly vital given that AIP applicants are not eligible for bridging open work permits during long PR processing times.
